March Rezoning/Special Use Hearings

The Johnston County Board of Commissioners will conduct Rezoning Petition and Special Use Permit Application Public Hearings for the following cases on Monday, March 6, 2017 at the 6:00 p.m. Commissioners Meeting in the Commissioners Meeting Room, Johnston County Courthouse, 207 E. Johnston Street, Smithfield, North Carolina.  After each rezoning case is heard, the rezoning public hearing, which is a legislative hearing, will be recessed and the Board will render a decision.  In the case of special use district rezonings, the special use hearing will be heard before reopening the hearing for the next case.  The special use hearing is a quasi-judicial hearing where the Board is sitting as judges and will hear factual evidence as testimony.

CASE 13-19 MOD:  Special Use Permit Petition: Petition to grant a Special Use Permit for a 3.16 acre tract located at the intersection of NC Hwy 96 N and NC Hwy 231 in O’Neals Township. The current zoning is General Business-Special Use District, with no defined uses.  Tax ID: 11L03046N.  Owner: Phillip Joseph Lewis.  Applicant: Glandon Forest Equity. 
Special Use Permit: To allow for a Commercial Retail business.

CASE 17-01:  Rezoning Petition: Petition to rezone 0.5 acres out of an 18.26-acre tract located at 186 Strickland Hinton Rd (SR 1729) in O’Neals Township from Agricultural Residential (AR) to General Business – Special Use District (GB-SUD).   Tax ID: 11L03035B.  Owner: Jermaine McKoy.   Applicant: Jermaine McKoy.  
Special Use Permit: Office, storage, and maintenance for five commercial vehicles.

Disposal of Surplus Property

The Johnston County Board of Commissioners adopted a resolution at their regularly scheduled meeting held on Tuesday, January 3, 2017, declaring certain personal property surplus and authorizing for the property to be sold by electronic public auction.  The property consists of the following:

2001 Ford Wheeled Coach 7.3 Engine VIN#1FDXE45F21HB51554    Mileage:  145,583
2009 Ford Wheeled Coach 6.0 Engine VIN#1FDXE45P19DA74316    Mileage:  136,628

The County will be using GovDeals (, an on-line auction service provider, for the disposal of this property.  The auction will begin on January 17, 2017 at 8:00 a.m. and end on February 28, 2017 at 5:00 p.m.  Registration is required for bidding.  All items are sold “as is”, and the acceptable methods of payment are cash, money order, and certified check.  Please review the terms and conditions before bidding.

Surplus Property – Upset Bid Process
308 E. Morgan Street, Benson, NC

The Johnston County Board of Commissioners has received an offer to purchase the following property for the sum of $51,000 (with the County crediting $1,800 towards closing costs):  A parcel of real property containing 0.16 acres of land and structures located at 308 E. Morgan Street, Benson, North Carolina (Johnston County Tax Parcel No. 01017026).  This property is being offered for sale under the negotiated offer, advertisement, and upset bid procedures prescribed in North Carolina General Statute 160A-269 and pursuant to resolution adopted by the Board of Commissioners on February 6, 2017.  Johnston County reserves the right to reject any and all bids.  Any person wishing to upset the offer must submit a written sealed bid to the Johnston County Clerk to Board located in the Johnston County Courthouse, PO Box 1049, 207 E. Johnston Street, Room B-206, Smithfield, North Carolina 27577, no later than 5:00 p.m. on Wednesday, February 22, 2017.  Displayed prominently somewhere on the front of the envelope should be displayed: “Sealed Bid for Property Located on 308 E. Morgan Street”Bids will be date/time stamped upon receipt.  Any bids received after 5:00 p.m. on Wednesday, February 22, 2017 will be rejected, regardless of the reason. 

Bid openings will occur on Thursday, February 23, 2017 at 9:00 AM at the Johnston County Courthouse, 207 E. Johnston Street, Room B-206, County Attorney’s Office, Smithfield, North Carolina and the highest qualifying bid will become the new offer.  If there is more than one bid in the highest amount, the first such bid received will become the new offer.  If a qualifying upset bid is received, the new offer will be advertised and the process continued until a ten (10) day period has passed without receipt of a qualifying upset bid.  To qualify as an upset bid, the offer must be at least $53,600 and must be accompanied by a bid deposit equal to 5% of the increased bid (deposits may be in the form of cash, cashier’s check or certified check payable to “County of Johnston”).  No offer will be accepted without a bid deposit and failure to so provide such bid deposit shall require rejection of the bid.  Bidder shall not attach any additional conditions to their bid and any such additional conditions attached to bids received shall render the bid non-responsive, and such shall not be considered by the Board.  All sales are “As-is/Where-is” with no warranties as to condition, habitability or environmental matters. Balance of purchase price is due upon closing. The high bid will be considered a continuing offer for a period of 90 calendar days. The Board of Commissioners maintains the right to reject any and all bids.  

The Description of the property set forth in this Notice and any other information provided therein with respect to said property is based on information available to the Johnston County Emergency Services Department and is believed to be correct, but any error or omission, including but not limited to the omission of any information available to the agency having custody over the property and/or any other state agency, shall not constitute ground or reason for nonperformance of the contract of sale, or claim by purchaser for allowance, refund or deduction from the purchase price.
