SPECIAL MEETING OF THE
JOHNSTON COUNTY FINANCE CORPORATION

NOTICE IS HEREBY GIVEN that there will be a special meeting of the Johnston County Finance Corporation (whose membership consists of the Johnston County Board of Commissioners) on Monday, June 5, 2017 immediately following the adjournment of the regular 10:00 a.m. Johnston County Board of Commissioners meeting in the Commissioners Meeting Room of the Johnston County Courthouse, 207 E. Johnston Street, Smithfield, North Carolina.  The purpose of the meeting is to adopt a resolution authorizing the execution, delivery and sale of limited obligation bonds for the purposes of financing all or a portion of the costs of (i) expanding, rehabilitating, renovating and equipping various existing public school facilities, (ii) the acquisition of any necessary rights-of-way and easements related to each of the foregoing and (iii) various real and personal property improvements related to each of the foregoing (collectively, the “2017 Projects”) in an aggregate principal amount up to $30,500,000.

Fiscal Year 2017-2018 County Budget Discussions
Johnston County Board of Commissioners

Please be advised that the Johnston County Board of Commissioners will hold special meetings for the purposes of discussing the Fiscal Year 2017-2018 County Budget on the following dates: 

Monday, June 12, 2017 at 6:00 p.m.
Monday, June 19, 2017 at 6:00 p.m.
Monday, June 26, 2017 at 8:30 a.m.

The meetings will be held in the Commissioners Meeting Room located in the Johnston County Courthouse, 207 E. Johnston Street, Smithfield, North Carolina.  Anyone wishing to address the Board and/or hear the discussions regarding the Fiscal Year 2017-2018 County Budget is invited to attend.  It is anticipated that the Board of Commissioners will adopt the Fiscal Year 2017-2018 County Budget at the June 26th meeting; therefore, anyone wishing to address the Board regarding the County Budget is encouraged to attend the June 12th or 19th meetings. 

Please be advised that the Board may also discuss and consider final Fiscal Year 2016-2017 budget revisions and other related budgetary matters at any of the special meetings.

PUBLIC HEARING
PROPOSED JOHNSTON COUNTY BUDGET

Pursuant to NCGS § 159-12, the Johnston County Board of Commissioners will hold a Public Hearing on the proposed 2017-2018 County Budget on Monday, June 5, 2017 at the 10:00 a.m. regular meeting held in the Commissioners’ Meeting Room, Johnston County Courthouse, 207 E. Johnston Street, Smithfield, NC 27577.  The hearing will begin immediately following the Public Comment section held at the beginning of the meeting (10:00 a.m.), or as soon thereafter as possible.

The purpose of the Public Hearing is for the County Manager to present the proposed budget and solicit public comment.

A copy of the proposed Budget has been submitted to the Board and is available in the Office of the Clerk to the Board for public inspection.  The Office of the Clerk to the Board is located at the Johnston County Courthouse, 207 E. Johnston Street, Smithfield, North Carolina 27577 Room B-206, ph. (919) 989-5100.

NOTICE OF PUBLIC HEARING
Proposed Plan of Financing

NOTICE IS HEREBY GIVEN that the Board of County Commissioners (the “Board”) of the County of Johnston, North Carolina (the “County”), will conduct a public hearing on June 5, 2017 concerning the execution and delivery of one or more installment financing contract(s) with the Johnston County Finance Corporation (the “Corporation”) or one or more third parties (collectively, the “Contracts”) to finance all or a portion of the costs of (i) expanding, rehabilitating, renovating and equipping various existing public school facilities, (ii) the acquisition of any necessary rights-of-way and easements related to each of the foregoing and (iii) various real and personal property improvements related to each of the foregoing (collectively, the “2017 Projects”).

The plan of financing for the 2017 Projects involves the entry by the County into one or more installment financing contract(s) with the Corporation or one or more third parties who will provide the County with up to $30,500,000 pursuant to the terms of said one or more installment financing contract(s), which amounts will be applied to provide financing for the 2017 Projects.  The County’s obligations to the Corporation or any third party supplying financing are authorized by North Carolina General Statutes §160A-20 and will be secured by a lien upon or security interest in all or some portion of the 2017 Projects and/or in all or some portion of the real property on which the 2017 Projects will be located.

The obligations of the County under the Contracts will not be deemed to be a pledge of the faith and credit of the County within the meaning of any constitutional debt limitation and the Contracts will not directly or indirectly or contingently obligate the County to make any payments beyond those appropriated in the sole discretion of the County for any fiscal year in which the Contracts are in effect.  No deficiency judgment may be rendered against the County in any action for breach of the Contracts and the taxing power of the County is not and may not be pledged directly or indirectly or contingently to secure any moneys due under the Contracts.

NOTICE OF PUBLIC HEARING
June Rezoning/Special Use Cases

The Johnston County Board of Commissioners will conduct Rezoning Petition and Special Use Permit Application Public Hearings for the following cases on Monday, June 5, 2017 at the 6:00 p.m. Commissioners Meeting in the Commissioners Meeting Room, Johnston County Courthouse, 207 E. Johnston Street, Smithfield, North Carolina.  After each rezoning case is heard, the rezoning public hearing, which is a legislative hearing, will be recessed and the Board will render a decision.  In the case of special use district rezonings, the special use hearing will be heard before reopening the hearing for the next case.  The special use hearing is a quasi-judicial hearing where the Board is sitting as judges and will hear factual evidence as testimony.
