NOTICE OF PUBLIC HEARING
Economic Development (N.C.G.S. §158-7.1(a))

    The Johnston County Board of Commissioners has scheduled a special meeting to be held on Monday, June 24, 2024, at 11:00 a.m.  The meeting will be held at the Johnston County Courthouse, Board of Commissioners Room, located at 207 E. Johnston Street, Smithfield, North Carolina.  The purpose of the special meeting is to hold a public hearing to receive public comment on a proposed economic development incentive grant for Project Ace.  A company proposes to expand existing manufacturing/production facilities in the Johnston County Research and Training Zone in the Clayton area of Johnston County.  The company has proposed the development in Johnston County in exchange for certain economic incentives including annual cash grants paid from general County funds over a twelve-year period beginning after required investments have been made and new jobs have been created.  The cash grants will not exceed the property taxes paid by the company in any given grant year.  The County believes this project will help stimulate the local economy and result in new taxable capital investments in real and personal property and the creation by the company of a substantial number of new, permanent jobs in the County.  The Board of Commissioners will solicit public comment on the proposed incentives at the public hearing. 

   The Board of Commissioners will consider approval of incentives to the company in exchange for the company’s commitments to (1) expand, develop, build, and operate the facilities, (2) create a substantial number of new, permanent full-time jobs and (3) invest in taxable business personal property additions, all of which will return property tax revenues substantially in excess of the County’s investment.  The cash grants are contingent upon, among other things, the company’s entry into a local economic development incentive agreement with the County containing the respective obligations and agreements of the company and the County.  The company must achieve its capital investment and job creation goals plus be current on all Johnston County tax obligations to receive the proposed grant funding, which is subject to adjustment for partial performance.   All interested persons are invited to attend and present their views during this public hearing.  Citizens who would like to address the Board regarding this hearing but have concerns with physically attending the meeting, may email those comments to Clerk to the Board Dana Cuddington at dana.cuddington@johnstonnc.com. NOTICE OF PUBLIC HEARING AND ORDER
AUTHORIZING THE ISSUANCE OF $120,000,000 GENERAL OBLIGATION SCHOOL BONDS
FOR THE PURPOSE OF FINANCING THE ACQUISITION, CONSTRUCTION AND EQUIPPING OF SCHOOL FACILITIES

BE IT ORDERED by the Board of Commissioners for the County of Johnston, North Carolina:

  1. Pursuant to The Local Government Bond Act, as amended, the County of Johnston, North Carolina, is hereby authorized to issue general obligation bonds of Johnston County for the purpose of providing funds, together with any other available funds, to finance the acquisition, construction and equipping of modifications, renovations, additions, improvements and extensions to existing facilities and/or one or more new buildings or other school facilities for Johnston County public schools, including acquisition of necessary land and rights-of-way.
  2. The bonds shall be in an aggregate principal amount not to exceed $120,000,000.
  3. The bonds shall be general obligations of Johnston County for the payment of principal of and interest on which its full faith and credit shall be irrevocably pledged and taxes will be levied in an amount sufficient to pay the principal of and interest on the bonds.
  4. A sworn statement of debt shall be filed with the Clerk to the Board of Commissioners pursuant to N.C.G.S. § 159-55 and be open to public inspection.
  5. This Bond Order shall take effect when approved by the voters of Johnston County.

The foregoing order has been introduced and a sworn statement of debt has been filed under The Local Government Bond Act showing the appraised value of the County of Johnston, North Carolina, to be $27,991,770,183 and the net debt thereof, including the proposed bonds, to be $558,371,000.  The finance officer of the County has filed a statement estimating that the total amount of interest that will be paid on the bonds over the expected term of the bonds, if issued, is $67,334,400.  A tax is authorized to be levied to pay the principal of and interest on the bonds if they are issued.  The finance officer has filed a statement estimating that no property tax increase will be required to provide sufficient funds to pay the principal and interest on the proposed bonds.  These estimates are preliminary, are for general informational purposes only, and may differ from the actual interest paid on the bonds or the actual property tax increases required to provide sufficient funds to pay the principal and interest on the bonds.  The assumptions upon which the foregoing estimates are based are set forth in a statement of the finance officer that has been filed with the Clerk to the Board of Commissioners and is open to public inspection.  There is no assurance that the circumstances included in such assumptions will occur; and the occurrence of certain of such assumptions is beyond the control of the County.  Differences between the actual circumstances at the time the bonds are issued from the assumptions included in the foregoing estimates could result in significant differences between the estimated interest and the actual interest on the bonds or the actual property tax increases required to provide sufficient funds to pay the principal and interest on the bonds.  Anyone who wishes to be heard on the questions of the validity of the bond order and the advisability of issuing the bonds may appear at a public hearing or an adjournment thereof to be held by the Board of Commissioners of said County at its regular meeting at 10:00 a.m., or as soon thereafter as the hearing can be held, on July 15, 2024 in the Commissioners’ Meeting Room in the Johnston County Courthouse Annex in Smithfield, North Carolina.

BE IT ORDERED by the Board of Commissioners for the County of Johnston, North Carolina:

  1.   3. The bonds shall be general obligations of Johnston County for the payment of principal of and interest on which its full faith and credit shall be irrevocably pledged and taxes will be levied in an amount sufficient to pay the principal of and interest on the bonds.
  4. A sworn statement of debt shall be filed with the Clerk to the Board of Commissioners pursuant to N.C.G.S. § 159-55 and be open to public inspection.
