County Owned Surplus Property

It is the policy of Johnston County to provide governmental services as effectively and efficiently as possible.  In order to do so, the Board of Commissioners has adopted a tax collection policy designed to ensure, to the maximum extent possible, that all citizen's pay all taxes required by law and that no one be allowed to avoid paying their full share under the law.  As the county pursues this policy, it will acquire property that has been subject to a public auction pursuant to a foreclosure proceeding.  The goal of the county in such sales shall be to attempt to recoup all taxes due on the property together with all applicable costs, including attorney's fees.  At times, no bid on the property will be made or the bids is deemed to be insufficient in light of the purpose of the sale; at such times, the county will acquire the subject property.  If the property acquired is deemed by the county to not be a property which can be effectively used to the public's benefit, the property will be made available to the public for sale in accordance with this policy.

A person expressing an interest in a property will be given an opportunity to purchase the property subject to a negotiated sale as set out by statue.  Under the statute, any negotiated sales price must be advertised and an opportunity provided for an upset bid.  A minimum asking price equal to the taxes due, together with applicable costs, including attorney's fee shall be required.  Any interested party will be asked to submit a bid for the property only after completion of the attached bid form agreement.
